The New York Times produced a three-part series of articles, When Workers Die, December 21 to 23, 2003, about OSHA's failure to seek prosecution when workers are killed on the job (even in the case of blatant or repeat violators of safety regulations) and some states' handling of the issue. The articles, by David Barstow, are (1) A Trench Caves In; A Young Worker is Dead. Is It a Crime?, (2) U.S. Rarely Seeks Charges for Deaths in Workplace, and (3) California Leads Prosecution of Employers in Job Deaths.
