Summary Statement

This proposed revision to 29 CFR 1926.51 for construction sanitation was prepared by the Sanitation Workgroup of OSHA's Advisory Committee on Construction Occupational Safety and Health, a 15-member committee of employee, government, and employer representatives from throughout the United States. The workgroup began its review process in 1998 with interested stakeholders. Some ACCSH members believe the standard is not enforced enough (it was the fifty-second most cited standard in 2003, according to OSHA, and was cited 342 times in the five years 1999 through 2003). The standard does not require hand washing and does not require toilets for "mobile crews," such as workers constructing a pipeline. The attached draft was endorsed by a unanimous vote of the full ACCSH Committee in March 2001 that included the committee's plea for OSHA to begin the regulatory process. As of March 2005, OSHA had not begun promulgation of a revised standard.
